This
summary is here to help. The articles below are what counts.
01Definitions
- Agency: BOONS AGENCY, based in Haarlem, the Netherlands.
- Artist: the DJ(s) or act(s) represented by the Agency and named in the booking
confirmation, including a back-to-back of two or more of them.
- Promoter: the person or organisation that books the Artist, such as a club,
festival, event organiser or private client.
- Performance: the Artist's appearance on the date, at the venue and for the set
time set out in the booking confirmation.
- Booking confirmation: the written confirmation sent by the Agency, by email or
as a document, stating the details and fee of the Performance.
- Agreement: the booking confirmation together with these terms and the Artist's
rider.
- Rider: the Artist's technical and hospitality requirements, as published on the
Artist's page or sent with the booking confirmation.
02Applicability
- These terms apply to every offer, option, booking confirmation and Agreement between the Agency
and a Promoter.
- The Agency acts on behalf of the Artist. It arranges the booking, invoices the fee and is the
Promoter's point of contact from first enquiry until after the Performance.
- The Promoter's own general terms do not apply, unless the Agency has accepted them in writing.
- Anything agreed in the booking confirmation that differs from these terms takes precedence over
these terms.
03Booking requests & agreement
- A booking request, through our website, by email or by direct message, is a non-binding
enquiry. Any availability we give at that stage is provisional.
- At the Promoter's request the Agency can hold a date as an option for up to
7 days. If the option is not confirmed within that period, it lapses and the date is released.
If a second party asks for the same date, the Agency may ask the Promoter to confirm or release the
option within 48 hours.
- The Agreement is formed once the Promoter has confirmed the booking confirmation in writing, by
signing it or by replying to it by email. From that moment the booking is binding for both sides.
- Changes to the date, venue, set time or set length after confirmation need the Agency's written
approval.
04Fee, invoicing & payment
- The fee is stated in the booking confirmation. If VAT applies, the confirmation says so.
Travel costs and accommodation are not included in the fee, unless stated otherwise (see
article 05).
- 50% of the fee is due within 14 days of the booking confirmation. The
remaining 50% is due no later than 7 days before the Performance.
- For bookings made less than 21 days before the Performance, the full fee is due within 3 days of
the booking confirmation, and in any case before the Performance.
- Payment is made to the bank account on the Agency's invoice, without any set-off or deduction.
Cash payment to the Artist on the night is only possible if agreed in writing beforehand.
- If payment is late, the Promoter is in default without further notice. The Agency may then charge
the statutory commercial interest and collection costs, and may suspend the Performance until
payment has been received in full. If the fee has not been paid in full 48 hours before the
Performance, the Agency may cancel it. In that case article 10 applies as if the Promoter had
cancelled.
- For Performances outside the Netherlands the fee is a net amount. Any local taxes, withholding
tax or levies are paid by the Promoter.
05Travel & accommodation
- For shows in the Netherlands, the Promoter pays the travel costs stated in the booking
confirmation, either as a fixed amount or per kilometre from the Artist's home base.
- If the Artist's set ends after the last reasonable public transport connection home, the
Promoter arranges and pays for return transport (taxi or driver) or for a hotel room.
- For shows abroad, the Promoter arranges and pays for flights or train tickets, local ground
transport and a hotel room with breakfast, in consultation with the Agency. Travel is booked in
the Artist's name and the tickets are sent to the Agency at least 14 days in advance.
- Where a back-to-back is booked, these arrangements apply to each Artist taking part.
06Promoter's obligations
- The Promoter provides at its own expense:
- a working DJ setup in line with the technical rider, set up and tested before the Artist
arrives, with a technician available during the Performance;
- the hospitality set out in the rider;
- all permits, licences and insurance needed for the event, including music rights (such as
Buma/Stemra and Sena) and public liability insurance;
- adequate security, a safe booth and a safe, lockable place to store the Artist's belongings;
- the guest list places set out in the Artist's rider, and at least 2 per Artist where the rider says nothing.
- The Promoter sends the Agency the address, arrival time, set time, on-site contact person with
phone number, and any access details no later than 7 days before the Performance.
- The Promoter makes sure the event complies with all applicable rules on safety, capacity and
noise.
- If the Promoter does not meet these obligations and the Performance becomes unsafe or
reasonably impossible as a result, the Artist may shorten or cancel the Performance and the full fee
remains due.
- We work to a clear standard of respect. The Artist may stop the Performance if the Artist, the
crew or the audience is threatened or harassed and the Promoter does not step in. The full fee
remains due.
07Set times, billing & back-to-back
- The Artist is ready at the venue in good time before the agreed set time and plays the full
agreed set length.
- If the Performance starts later or is shortened for reasons outside the Artist's control, such as
the programme running late or an early closing time, the full fee remains due.
- The Artist's name is billed as agreed in the booking confirmation. If nothing is agreed, the
Promoter consults the Agency on the line-up billing before announcing it.
- A back-to-back (for example BURNEY b2b GIBBS) is booked as a single
Performance with its own fee. It cannot be changed into a solo set, or the other way round, without
the Agency's written approval.
- If an exclusivity radius or period is agreed in the booking confirmation, the Agency will not
book the Artist within that radius or period.
08Promotion & press kit
- The Promoter may use the Artist's name, photos, logo and bios from the press kit on our website
to promote the confirmed Performance. Once the Agreement ends or is cancelled, that permission ends
too.
- Photos may be cropped, but not altered in any other way: no filters, no text over the Artist's
face, and no other logos on the photo. Where a photographer is named, they are credited.
- The Promoter tags the Artist and the Agency in social media posts about the Performance.
- The Artist's name or image may not be used to endorse brands, sponsors or products, and the
Artist may not be presented as headliner or exclusive act, unless agreed in writing.
09Recording & content
- The Promoter may photograph and film the Performance for its own social media, event pages and
aftermovie, provided the Artist is tagged or credited.
- Livestreaming, broadcasting, or publishing a recording of the full set, or more than a few
minutes of it, requires the Agency's prior written consent. The same applies to any commercial use.
- The Promoter sends the Agency photos and video of the Performance within 14 days, free of
charge, for the Artist's own non-commercial use, with credit to the photographer.
- The Artist and the Artist's own crew may film and photograph the Performance for the Artist's
own channels.
- Consent to record never transfers any rights in the Artist's performance, name or music.
10Cancellation by the promoter
- Cancellation must be made in writing. The moment the Agency receives it counts.
- On cancellation the Promoter pays the following part of the fee:
| Cancelled | Due |
| More than 60 days before the Performance | 25% |
| 60 to 30 days before | 50% |
| 29 to 14 days before | 75% |
| Less than 14 days before, or a no-show by the Promoter | 100% |
- Costs already incurred that cannot be refunded, such as travel and accommodation, are paid in
full in addition.
- If an outdoor event is cancelled or moved because of the weather, this counts as cancellation by
the Promoter, unless the event was prohibited by the authorities (article 11.3).
- If the Promoter moves the Performance to a new date that the Agency accepts within 30 days of the
original date, the amounts already paid are carried over to the new date.
11Cancellation by the artist & force majeure
- If the Artist cannot perform because of illness, injury, a family emergency or another cause
beyond the Artist's reasonable control, the Agency informs the Promoter as soon as possible.
- The Agency will then propose a new date or, if the Promoter wishes, a suitable replacement from
our roster. If neither works for the Promoter, all amounts already paid are refunded in full. The
Agency and the Artist are not liable for any further damage.
- Neither party is liable if the Performance cannot take place because of force majeure. This
includes government measures or a ban on the event, epidemics, strikes, severe weather warnings
(code red), terrorism, war and the failure of public transport or infrastructure. Amounts paid are
refunded, minus costs the Agency or Artist cannot recover, and each party bears its own other
costs.
12Liability
- The liability of the Agency and the Artist is limited to the amount of the fee for the
Performance concerned.
- The Agency and the Artist are not liable for indirect or consequential loss, such as lost
profit, lost ticket sales, refunds to visitors or reputational damage.
- The Promoter is liable for damage to or loss of the Artist's equipment and belongings at the
venue, unless caused by the Artist.
- The Promoter indemnifies the Agency and the Artist against claims by third parties related to
the event, unless the claim results from intent or deliberate recklessness on their part.
- These limitations do not apply in the case of intent or deliberate recklessness, or where the
law does not allow them.
13Complaints
- Complaints about a Performance are sent in writing to
Bookings@boons-agency.nl within 7 days of the
Performance, with as much detail as possible.
- We respond within 14 days. A complaint does not suspend the Promoter's payment obligations.
14Privacy
- When you send a booking request through our website, we receive the details you enter: your name,
email address and, if you give it, phone number, plus the details of your event. The form is sent through our own form server at our Dutch hosting provider,
Vimexx, and reaches us by email.
- We use these details only to handle your request and any booking that follows. We do not sell
them or use them for newsletters without asking you first.
- We keep booking requests that do not lead to a booking for no longer than 12 months. Details
of confirmed bookings are kept as long as Dutch tax law requires (7 years).
- When you sign up for BOONS COLLECTIVE, we receive what you do (for example DJ, VJ or photographer), your artist name and name, email address, phone number, city, sound or style and Instagram, plus anything optional you add (a portfolio link, how you found us, what you are looking for, a message) and your confirmation that you are 18 or older, also through our own form server. We use them only to contact you about the collective, and delete them when you leave it, or after 12 months if you do not join. Being listed is part of membership: if you join, we show your artist name, role, city, Instagram and the photo you choose on our Collective page, never your real name or contact details. Leave the collective and we take you off the page.
- Our forms are protected against spam with Cloudflare Turnstile. To tell people from bots, Cloudflare
briefly checks details of your browser and connection, such as your IP address. It sets no tracking
cookies, and Cloudflare's own privacy policy applies to this check.
- To see how our website is used, we count visits with GoatCounter. It uses no cookies and stores
no personal data: we only see totals, such as how many people viewed a page, which site they came
from and roughly which country they were in. That is why this site has no cookie banner.
- The music players on the artist pages are embedded from SoundCloud. SoundCloud's own privacy
and cookie policy applies to those players.
- You can ask us at any time to see, correct or delete your details by emailing
Bookings@boons-agency.nl.
15Applicable law & changes
- Dutch law applies to these terms and to every Agreement.
- Disputes are submitted exclusively to the competent court in the district of Noord-Holland
(Haarlem), unless the law requires otherwise. We will always try to resolve a dispute together
first.
- The Agency may update these terms. A booking is governed by the version in force on the date of
its booking confirmation.
- These terms are drawn up in English. If they are translated, the English version prevails.
